In the following, we present to you our general terms and conditions. This is where you can find all the important information on shopping at SugarShape.

1. Scope

The following general terms and conditions apply for all orders placed through our online shop.

2. Contractual Partner, Conclusion of Contract

The contract is concluded with SugarShape.

By placing products in the online shop, we submit a binding offer on these articles for the conclusion of a contract. Putting our products in the shopping cart is initially non-binding for you and you may correct your entries at any time – using the correction assistance provided during the order process – prior to sending your binding order. Your binding order for the articles in your shopping cart is submitted by clicking on the Order button. Directly after placing the order you will receive an order confirmation per email.

3. Contractual Language, Contract Detail Storage

The exclusive language available for conclusion of contract is German.
We save the contract details and send you the order information along with our general terms and conditions per email. You can also access the general terms and conditions at any time here on this page. You can access your previous orders by using our customer login.

4. Cancellation Policy

Right of Withdrawal

You have the right to withdraw from the contract without stating reasons within fourteen days. The withdrawal period is fourteen days from the day on which you, or a third party designated by you – other than the carrier – has taken the items into possession. To exercise your right of withdraw you must inform us (SugarShape GmbH, Fliegenberg 100, 21435 Stelle, service@sugarshape.de, telephone: 0800 600 70 50) by means of a clear declaration (for example a letter sent via the post office, a fax or an email) of your decision to withdraw from the contract. You can use the enclosed sample withdrawal form but this is not required. To meet the withdrawal deadline it will suffice to send this declaration prior to the expiration of the withdrawal period.

Consequences of Withdrawal

If you withdraw from this contract we must refund all payments that we have received from you, including shipping costs (with the exception of any additional costs incurred should you have decided to use a shipment method other than the most economical standard shipping method we offer) immediately or at the latest within fourteen days of receipt of your notice of withdrawal. We will use the same payment method for this refund that you used for your original transaction unless another method is expressly agreed upon with you; under no circumstances will you be charged for this refund. We can refuse to refund you until we have received the items that were ordered, or until you provide evidence that you have sent back the items, depending on whichever happens first. You must send back or hand over the items promptly or at the latest within fourteen days of notifying us of your withdrawal from the contract. The deadline shall be deemed to have been met if you have the items dispatched before expiry of thedeadline of fourteen days. You are obliged to pay for any possible loss in value of the items only if – upon checking the condition, quality and functionality of the items – it is determined that this loss of value is attributable to the unnecessary handling of them by you.

5. Delivery Terms and Conditions

Shipment costs depend on the order value

For shipments within Germany, we charge shipping costs of 4.50 € per order; consignments whose invoice amount equals or exceeds 100 € are shipped free of charge. Free shipments will become subject to shipping costs in the event that returned goods result in a dropping of the total purchase price below 100 €.

For shipments to Austria, Belgium, Luxemburg and The Netherlands, we charge a shipping cost of 4.95 € per order; shipments with a billing amount of 150 € or higher are shipped free of charge. Free shipments will become subject to shipping costs in the event that returned goods result in a dropping of the affected consignment’s purchase price below 150 €.

We deliver by shipping only. Unfortunately, collection by the customer is not possible.

6. Payment

The following methods of payment are available to you at our shop:

Advance Payment

If you select advance payment as your payment mode, we will send you a separate email with our bank details and ship the order upon receipt of payment.

Credit Card

When placing the order you convey to us your credit card information at the same time. After you are verified as the legitimate credit card bearer, we will ask your credit card company to initiate a payment transaction immediately upon shipment of the order. The payment transaction will be processed automatically by your credit card company and your credit card will be debited.

PayPal

During the order process you will be transferred to the website of the online provider PayPal. In order to pay the invoice amount via PayPal you must be registered as a PayPal customer or you must register first with PayPal, verify your credentials by logging in, and confirm the payment order to us. After placing the order in our shop we ask PayPal to initiate a payment transaction. The payment transaction will be processed automatically by PayPal immediately following that. You will receive additional information during the order process.

Sofort.

After placing the order you will be transferred to the website of the fast transfer online provider Sofort. In order to pay the order amount via Sofort you must have access to an online banking account with the PIN/TAN method at a bank that has been permitted to work together with Sofort. You then log in with your credentials and confirm the payment order to us. You will receive more information during the order process. The payment transaction will be processed automatically by Sofort and debited to your account.

Invoice

When the purchase is made per invoice, the company Bürgel Wirtschaftsinformationen GmbH & Co. KG, Postbox 500 166, 22701 Hamburg, will make available to us information stored in their data base with regard to your address and creditworthiness. This includes such information that is gained by a process using mathematical and statistical techniques, provided we have presented a credible justified interest. For the purpose of deciding on the rationale, execution or termination of the contractual relationship, we collect or use probability values in whose calculation address data is involved.

7. Retention of Title

The articles remain our property until complete payment is made.

8. Shipping damages

If articles are delivered with obvious shipping damages, please make a claim to the carrier as soon as possible and contact us immediately. Neglecting to make this claim or contact us has absolutely no consequences with regard to your legal claims – especially your warranty rights – or their enforcement. This helps us, however, to assert our claims vis-a-vis the carrier or transport insurance.

9. Warranty and Guarantees

The statutory warranty rights apply. You will find information about other additional guarantees that may apply, and their exact terms and conditions, with each of the articles as well as on special information pages within the online shop.

10. Liability

For claims arising from damages caused by us, our legal representatives or vicarious agents we shall be liable without limitation

  • in case of damages arising from injury to life, body and health,
  • in case of willful or grossly negligent breach of duty,
  • in case of warranty commitments, as far as agreed, and
  • to the extent that applicability of the Product Liability Law is opened.

In the event of violation of essential contractual obligations, whose fulfilment is a prerequisite for proper fulfilment of the contract in the first place, and whose observance is regularly relied upon by the contractual partner (cardinal duties) through slight negligence on our part, the part of our legal representatives or vicarious agents, the liability will be restricted to the foreseeable damage that is to be typically expected in such an event at contract conclusion. All other claims for damages shall be excluded.

11. Dispute Resolution

The European Commission has provided a platform for online dispute resolution (OS platform) which you can find here http://ec.europa.eu/consumers/odr/. Consumers have the chance to use this platform to resolve their differences. We are obligated to participate in dispute resolution procedures before a consumer arbitration board when it comes to settling disputes with consumers arising from a contractual relationship, or settling whether such a contractual relationship even exists. We agree to participate in dispute resolution procedures before this board.
